I. CALL TO ORDER

Chair Chandler Felt convened the meeting at 7:05 P.M.

II. ROLL CALL

The following members were present:

III. Public Comment  

There were no public comments.  

IV. MINUTES:

Chair Felt presented the minutes of the Regular Meeting of August 11, 2022, for review and action by the Board members.

Action: Jay Hamlin moved and Marlin Gabbert seconded the motion to adopt the minutes for the Regular Meeting of August 11, 2022.

Board members voted seven in favor of approving this record of the Regular Meeting. Bob Cook Abstained as he did not attend the August 11, 2022 meeting.  

V. ADMINISTRATION

A. Chair's Report.

Chair Felt stated that six members plus Ms. Miklethun are slated to attend the Washington Association for Boundary Review Boards (WSABRB) 2022 Annual Conference in Stevenson, WA.  He shared planned agenda highlights and expressed his pleasure that so many members plan to attend.  Ms. Blauman added that she is scheduled to present materials usually presented by Mr. Kaufman as he has a scheduling conflict and cannot attend.  

Chair Felt reminded the members that committee members and chairs need to be named for 2023 and asked members to consider those positions.  Chair Felt added that the Board will need to name a 2023 Chair Elect/2024 Chair and asked members to think about potential candidates for that role.

B. Committee Reports.

1. Budget Committee

Committee Chair Claudia Hirschey asked Ms. Miklethun to provide an update on the Board’s 2023-2024 Biennial Budget.  Ms. Miklethun shared that Executive Constantine will transmit his biennial budget proposal to the King County Council on September 27, 2022.  She stated that the Board’s portion of that budget reflects some reductions in the Board’s variable spending in areas such as postage as office supplies.  She added that the Board is completely funded by the County’s General Fund and all agencies funded by that fund have been asked by County budget staff make reductions where they are feasible.  She relayed that Council staff will have an opportunity to ask questions of agencies after the budget is transmitted and that the Council will vote on the budget before Thanksgiving.  Paul MacCready asked Ms. Miklethun if she anticipated questions or concerns from Council staff, and Ms. Miklethun replied that she did not.  Mary Lynne Evans asked if Washington State provided funds for the Board, and Ms. Miklethun that it does not.  Mr. Kaufman added that although the statute includes language for funding boundary review boards, he does not believe that Washington State has historically provided that funding.  Ms. Blauman added that the statute states that if Washington State does not fund boundary review boards, then the counties must fund them.  

2. Legislative Committee

Chair Felt shared that he has been attending APA Legislative Committee meetings on Fridays to plan for the 2023 Legislative Session.  He relayed that APA Washington Lobbyist Mike Shaw has shared his belief that both middle housing and climate bills will again be filed in the upcoming session but has not mentioned annexation issues/bills.  Additionally, Chair Felt added that these Friday meetings have included presentations from representatives from agencies that align with APA Washington topics of interest like public housing (King County Housing Authority), climate and middle housing legislation (Futurewise), and utility capacity issues (Realtors of WA and utility district association).  Mary Lynne Evans added that the Committee is working on its presentation for the WSABRB Conference.  

C. Executive Secretary’s Report

1. OCTOBER MEETING CANCELLATION

Ms. Miklethun reminded members that the October regular meeting will be canceled due to the WSABRB Conference and that the next regular meeting will be held on November 10.  She shared that there will be at least one Notice of Intention (NOI) that will need to be discussed at that meeting.  

2. MRSC - MISSING MIDDLE HOUSING WEBINAR

Ms. Miklethun shared that there would be an upcoming webinar presented by the MRSC regarding missing middle housing and that members should let her know if they want to attend.  Ms. Miklethun shared the link to the MRSC Missing Middle Housing website.  

3. KING COUNTY COMPREHENSIVE PLAN UPDATE SURVEY

Ms. Miklethun shared that King County is conducting a survey in support of its 2024 Comprehensive Plan Update.  She encouraged members to take the survey if they wished and shared that she had taken it and that was divided into sections for housing and climate change. 

4. WSABRB CONFERENCE

Ms. Miklethun relayed that the WSABRB will need to know ahead of time if attendees are brining guests to the dinner and that guests will need to pay a $50.00 fee to cover their guest’s meal.  She then thanked Ms. Velasquez for registering attendees and reminded members to submit their vouchers to Ms. Velasquez in a timely fashion.  

5. BOARD MEMBER POSITION UPDATE

Ms. Miklethun shared that there are four position terms up at the end of January 2023.  She added that she is working with Elsa Brown of the City of Seattle regarding the Cities’ positions and will be working with the Executive’s office regarding its one position.  

D. SPECIAL GUEST - RETIRED EXECUTIVE SECRETARY LENORA BLAUMAN.

Ms. Blauman expressed her support of Ms. Miklethun’s onboarding into the role of Executive Secretary and thanked all the members for their thoughts, notes and kind sentiments regarding her retirement.   

E. CORRESPONDENCE/ARTICLES OF INTEREST

Ms. Miklethun shared that the Nominating Committee will be scheduling a meeting to discuss the nomination communication received from the Washington Association of Sewer & Water Districts regarding the Board’s current vacancy.

VI. ORGANIZATION AND RULES OF PRACTICE AND PROCEDURE (ORPP) DISCUSSION AND VOTE 

Steering Committee Chair Margeson shared that the Steering Committee met on September 15, 2022 in order to consider changes that Board discussed at it August 11, 2022 regular meeting as well as some minor additional changes described in this meeting’s Agenda.  Committee Chair Margeson described proposed changes in the requirements for filing a NOI.  He relayed that the proposed changes are not intended to be all-inclusive or to take the place of the Board’s Instructions but rather to be a guide for both users and members.  He then walked members through additional proposed changes such as the voluntary prereview process that filing agencies can do with staff before filing a NOI as well as changing Mr. Kaufman’s title to “Board’s Counsel.” 

Action: Chair Margeson moved and Jay Hamlin seconded the motion that the Board approve the proposed amendments to the ORPP.
Board members voted eight in favor of approving the motion to amend the ORPP.
 
VII. NEW BUSINESS

A. New Files

The Board received two Notices of Intention (2410 and 2411) submitted by the Sammamish Plateau Water and Sewer District “the District.”  The members received summaries for File Nos. 2410 and 2411 in their meeting packets.  Ms. Miklethun shared King County iMap mapping of the proposed annexation areas.  The members discussed the files including the District’s reporting that it already provides service in these areas.

Regarding 2410, Ms. Miklethun relayed that the District reported that the parcels were originally to be included in the Ames Lake Water Association service area.  However, the Ames Lake Water Association would have had to cross some of the District’s infrastructure in order to provide service.  Accordingly, the two organizations decided that the District would be a more logical provider of water service to the proposed annexation area.  Ms. Miklethun and the members also discussed that the parcels in this area are listed as vacant and there is documented permitting activity regarding a single residence and a horse pasture.  However, she reported that one can see additional development activity on the parcels via publicly available mapping, and the area is zoned RA-5.  Chair Felt stated that the maximum that area under current zoning would be 16 houses or about 40 people.  The members then discussed the water line capacity in the NOI.  

Regarding 2411, Ms. Miklethun reported that the annexation area is completely within the City of Issaquah “the City” and that the District is the owner of several of the parcels.  She stated that the District stated that it and the City had conducted a study and determined that the District was the most logical provider of sewer service in that area.  She added that the District and the City entered into an interlocal agreement formalizing the same.  Chair Felt added that there was significant current use of parcels the annexation area based on publicly available mapping.

Note: There are 13 unincorporated urban areas in King County that are not assigned to a Potential Annexation Area.
