Supplemental Notice

In addition to Striking Amendment S3 and the line amendments described below, the Council may consider, and potentially adopt, other amendments on July 21, 2020 or thereafter. This includes the following concepts:

• Affordable Housing Provisions.In Striking Amendment S3, properties in the R-4 through R-48 zones could be developed to 200% of the base density of the zone, if all units over 150% of the base density were affordable at 40% of Area Median Income (AMI), and Transfer of Development Rights (TDRs) were purchased for those additional units. The price of TDRs for this purpose would be capped at 15% of fair market value of the TDR. The newly proposed amendment concept would retain the ability to achieve 200% base density through providing units affordable at 40% AMI, but would remove the requirement that TDRs be used to achieve this density.
• Winery/Brewery/Distillery Regulations.In the 2020 KCCP Update, the underlying code that adopted the regulations for wineries, breweries, distilleries and remote tasting rooms was engrossed into the striking amendment.The Council is considering whether to modify that underlying language, including repealing the regulations and adding requirements for the Executive to transmit a new ordinance with regulations for wineries, breweries, distilleries and remote tasting rooms based on the SEPA review being completed on Ordinance 19030.

Public testimony on these proposals will be allowed at the July 21, 2020 continued public hearing before the King County Council, which begins at 1:00 p.m. The public hearing will be held remotely to comply with the Washington State Governor's Declaration 20-28 (or as amended) regarding the Open Public Meetings Act.  Information on how to provide comment at the hearing is available here: https://www.kingcounty.gov/council/committees/full_council.aspx

On Monday, June 8, 2020, the Executive branch issued a Determination of Significance for 2020 Amendments to the King County Comprehensive Plan, Adoption of Existing Environmental Documents, and 2020 Addendum to Existing Environmental Documents, in accordance with the State Environmental Policy Act (SEPA).
